This panel presentation features the chairpersons of the four subcommittees that are dedicated to reviewing and keeping current each respective set of NGFA's Trade Rules – the Barge Trading Rules, Barge Freight Trading Rules, Feed Trade Rules, and Grain Trade Rules. This session will provide a strong general background in the nature, structure and application of the NGFA Trade Rules, with an emphasis upon rules that are of particular interest and importance to the trade today.

10:00AM - Session II – NGFA Arbitration – ADR for the Industry

Charles M. Delacruz , NGFA National Secretary & Counsel for Public Affairs, [confirmed]

Featuring the chair of the NGFA committee that is appointed to address appealed arbitration cases and to monitor and recommend changes to the arbitration system and rules – and the National Secretary who administers the system – this session provides a comprehensive review of the arbitration process. Special focus will be upon trends, and recurring problems and pitfalls that often make the difference between having arbitration as an option in lieu of going to court.

11:15AM - Session III – Introductory Contract Law

This session is designed to provide attendees with an introductory overview on the basic principles involved in trading, producer contracting law and the Uniform Commercial Code. This session covers the foundation – in trading rules, arbitration, and contract law – that attendees will apply in the case
studies and other sessions that follow in the program.

Session IV– Assignment and Preparation of Case Studies

Steve Lucas, President, Jayhawker Consulting Co. LLC [confirmed]

During this widely popular session, seminar attendees are assigned to specific case studies designed to illustrate how real-life occurrences in the trade become disputes. Participants are grouped together forming arbitration committees that analyze the cases and formulate their own judgments, which are then assessed to instruct participants on how such disputes may be resolved, if not avoided altogether, in the real world.

This session provides a thorough review of key issues, governmental and other players, and political and commercial developments affecting US-Mexico trade. Seminar attendees will be apprised of challenges faced by the industry in cross-border trade and the potential for reliance by the trade upon NGFA's Trade Rules in Mexico.


2:15PM - Session VI – Bioterrorism Recordkeeping/Contracting Issues

With the rapidly approaching deadlines set by the FDA for compliance with extensive recordkeeping requirements, this session is dedicated toward providing an understanding of these requirements and the tools necessary to achieve compliance. Included in this session will be a discussion of traceability requirements, and the NGFA's Bioterrorism Recordkeeping Compliance Guide – an invaluable resource for each seminar participant.

3:15PM - Session VII – Mycotoxins in Feeds/Contracting issues

To address the marketplace disruptions affecting feed products and export corn shipments from the emergence of mycotoxins in some regions this past harvest season – this special session will examine the importance of proper sampling procedures for detecting mycotoxins in inbound shipments, as well as the availability of various tests for determining whether mycotoxins are present and at what levels.

As follow up – the next day's presentation by legal experts will include a discussion of provisions in grain purchase contracts governing mycotoxins to ensure that the quality of grain being contracted for is appropriate for its intended use.

This panel of legal experts will present an overview on essential contracting principles, and address a variety of critical legal issues facing the industry with significant potential risks. The hot legal topics include: potential liabilities to the trade from the introduction of non-approved biotech products; antitrust risks for the industry; contracting issues particular to cash vs. forward transactions; and – ta king off on the previous day's mycotoxins-related session, the importance of appropriate provisions in grain purchase contracts to ensure that the quality of grain being contracted for is appropriate for its intended use .

At the conclusion of the program, seminar attendees have the option of taking an examination intended to gauge the participant's knowledge of the various topics addressed. The tests are subsequently evaluated, and a handsome certificate is mailed to those participants who successfully complete the exam.
